Optimum Online Wi-Fi

Please read the Terms of Service below for both Optimum Online and Optimum Voice services and indicate that you have reviewed and agreed to both the terms. Please note the Terms for each of the Services are presented separately one after the other. You must agree to the Terms of Service to proceed with the installation.

Terms of Service

AGREEMENT FOR OPTIMUM ONLINE(r)
AND OPTIMUM ONLINE BOOST

CSC Holdings, Inc. ("Cablevision") is pleased to provide its Optimum Online high-speed Internet access (the "Optimum Online Service(s)") to you in accordance with these terms and conditions, which terms and conditions incorporate and include the Cablevision Internet Product Acceptable Use Policy and Optimum Online Subscriber Privacy Policy, as they may be changed from time to time.
Subscriber's use of the Optimum Online Service(s) shall be deemed acknowledgment that Subscriber has read and agreed to these terms of service. This is a legal document.

1. Definitions:

(a) Subscriber or User: Each member of your household and any other individual who uses the Computer and Optimum Online irrespective of the individual in whose name the account is in or who owns, rents or uses the premises on which the Computer is located.

(b) Computer: An electronic device that can store, receive and process data and which has the minimum requirements necessary to operate Optimum Online as outlined in the consumer informational literature provided by Cablevision for Optimum Online.

(c) Dynamic Domain Name Service ("DNS"): A system that allows an Internet domain name to be linked to a dynamic IP address.  Dynamic DNS simulates a static IP address for access from the outside world.

(d) Equipment: All equipment owned by Cablevision delivered to and installed in Subscriber's home including but not limited to all cable wire, the Modem (unless purchased separately) and certain software necessary to receive Optimum Online Service.

(e) Modem: A device that converts and transmits computer data over cable lines.

(f) Optimum Online: An electronic two way online information and communication service of Cablevision (which includes proprietary products of Optimum Online as well as Internet access) which is delivered over the cable system and accessed by your personal computer via a cable modem.  Unless specifically authorized by Cablevision, Optimum Online is a residential, non-commercial service and these Terms of Service govern.  In the event that Cablevision has expressly authorized Subscriber to use Optimum Online for commercial or business purposes, the additional terms of service at http://www.optimum.com/support/terms.jsp?t=ool shall also apply.  In the event of a conflict between the commercial/business terms of service and these Terms of Service for such authorized Subscribers, the former shall govern.

(g) Optimum Online Boost: An enhanced electronic two way online information and communication service of Cablevision (which includes proprietary products of Optimum Online as well as Internet access) which is delivered over the cable system and accessed by your personal computer via modem.  Optimum Online Boost offers subscribers additional features that may be provided by authorized third party providers ("Boost Third-Party Provider(s)").  Optimum Online Boost may be used for commercial purposes.

(h) Optimum Online Service(s): Collectively, both the Optimum Online and Optimum Online Boost unless otherwise noted.  Any third-party providers of co-branded services offered as part of or through the Optimum Online Service shall be referred to as "Third-Party Provider(s)" and such term shall include all Boost Third-Party Providers.

(i) Optimum Online Video Service(s): The Optimum Online Video Services provide Subscribers to Optimum Online Boost with live TV programs and may include access to downloads of other video content.

(j) Optimum Online Voice: Unlimited digital phone service within the United States, Puerto Rico (except for commercial or business Subscribers) and Canada with an optional international calling plan for direct-dialed calls made from the Subscriber's authorized service location to locations out of the United States, Puerto Rico and Canada.

(k) Optimum Online Wi-Fi Services: Dial-up and Wi-Fi Internet access services made available to Subscribers to Optimum Online for an additional charge which includes: (i) Optimum Online Wi-Fi Web Portal for signup and account management and (ii) Optimum Online Wi-Fi Desktop Client[eeb1].

(l) Web Hosting Service(s):  Website creation tools provide Subscribers to Optimum Online Boost with web hosting services without having to use their computers as the web server.  Certain web hosting services are available to Optimum Online Boost Subscribers at no additional charge.  Additional services, charges and payment terms for such services are listed on the Web Hosting Services portal.

2. Services Provided: The Optimum Online Service provides Internet access, as well as access to certain proprietary products of the Optimum Online Service. Through access to the Internet, you also can subscribe to services such as America Online and CompuServe (collectively the "Services") and transact other forms of electronic commerce. Additionally, Optimum Online Boost may provide advanced features such as video downloads, web hosting and Dynamic DNS and also may provide access to purchase additional servicesfrom Boost Third-Party Providers.  Subscriber acknowledges that Subscriber may incur charges while using the Services or while engaging in other forms of "e-commerce" (i.e. charges may be incurred as a result of accessing certain information, or purchasing or subscribing to certain offerings via the Optimum Online Service or the Services.) All such charges owed to parties other than Cablevision, including applicable taxes shall be paid by Subscriber to the Services an!
d are not the responsibility of Cablevision.

3. Payment of Charges:

(a) Cablevision Charges.  Subscriber agrees to pay the monthly rate and other fees, including applicable fees and taxes, if any, for Optimum Online Service, as established from time to time by Cablevision. Subscriber must pay all undisputed monthly charges as itemized on the Cablevision monthly invoice and notify Cablevision of disputed items within thirty (30) days of receipt, or longer as provided by applicable law. Failure to pay charges invoiced (including checks returned for insufficient funds) may result in discontinuance of service, the removal of all equipment delivered and the imposition of late payment or service charge. Rates for the Optimum Online Service, Equipment, installation and all related services hereunder are subject to change in accordance with applicable law.  Subscribers may incur additional charges for using certain Optimum Online Service features that are not included in the Cablevision monthly subscription fees. 

(b) Third-Party Provider charges.  Subscriber authorizes that any charges including, additional fees and taxes, incurred by Subscriber billed directly by a  Third-Party Provider may be charged directly to Subscriber's credit card or in the event any Third-Party Provider is unable to charge such amounts to the credit card number Subscriber has provided, Subscriber remains responsible for any such charges and agrees to pay by another means acceptable to the affected Third Party Provider. 

4. Computer Equipment: Subscriber acknowledges and agrees that it has the minimum Computer requirements necessary to operate the Optimum Online Service and/or Optimum Online Boost as outlined in the consumer informational literature provided by Cablevision.

5. Disruption of Service: Subject to applicable law, credit with respect to Subscriber's recurring monthly subscription fee shall be given for qualifying outages of the Optimum Online Service. In any event, if there is a known service interruption in excess of twenty-four (24) consecutive hours (or in excess of such lesser time period pursuant to state law), Cablevision, upon prompt notification of such failure or interruption from Subscriber, shall provide Subscriber with a pro-rata credit for charges billed by Cablevision relating to such failure or interruption. Credits or billing adjustments for services billed by a Third-Party Provider shall be subject to the stated billing practices of that Third-Party Provider.  In no event shall Cablevision or any Third-Party Provider be liable for any incidental or consequential damages.

6. Repair of Cablevision Equipment:

(a) Cablevision will repair or replace defective Equipment in accordance with the applicable pricing schedule, if any, as long as such damage was not caused by misuse or other improper operations or handling by Subscriber. Cablevision shall have the right to presume misuse or other improper operations or handling by Subscriber in the event Subscriber requests repair or replacement more than twice in any twelve-(12-) month period, or more than three times in any twenty-four-(24-) month period, and shall have no obligation to fulfill any such repair or replacement.

(b) Cablevision is not responsible for the maintenance or repair of Subscriber's Computer, Modem (if Subscriber-owned) or related Subscriber-owned equipment. A service charge may be imposed upon the dispatch of a technician, if there is damage to Cablevision's Equipment due to negligent use or abuse or if no fault is discovered in Cablevision's system or Equipment. Cablevision makes no warranties with respect to the Equipment or Modem's compatibility with Subscriber's Computer.

7. Relocating Equipment: Cablevision's system is highly sophisticated and sensitive. Any "break" in the integrity of the cable system will subject the system to "ingress" of radio signals, which will disrupt your service and may affect that of others. Cable modems are not "portable" and are not permitted to operate at any location other than the address that appears on the subscriber's account. Accordingly, Subscriber agrees that Subscriber will not relocate, move or in any way tamper with or relocate the Optimum Online Service. Notwithstanding the foregoing, upon receipt of a request by Subscriber, Cablevision shall relocate the Optimum Online Service for Subscriber within Subscriber's home at a time mutually agreed to by Cablevision and Subscriber. If the Subscriber moves residences outside of Cablevision's service area, Subscriber shall notify Cablevision that this Agreement shall be terminated and the provisions of Section 14 shall apply to such termination. In all cases, Subscriber shall notify Cablevision pursuant to Section 8 below. Subscriber may incur a charge for such relocation and should consult a current Optimum Online schedule of rates and charges prior to requesting such relocation.

9. Subscriber Property: Cablevision assumes no liability for the condition or repair of any Subscriber owned hardware or software. Subscriber is responsible for the repair and maintenance of all such Subscriber hardware and software.

10. Taxes: Subscriber agrees to pay any local, state or federal taxes imposed or levied on or with respect to the Optimum Online Service, the Services, the Equipment or installation or service charges incurred with respect to the same.

11. Cablevision's Rights:

(a) Cablevision has no obligation to monitor Optimum Online Service content. However, Subscriber acknowledges and agrees that Cablevision has the right to monitor content electronically from time to time and to disclose any information as necessary to satisfy any law, regulation or other governmental request, to operate Optimum Online Service properly, including, but not limited to, monitoring of a Subscriber's access to certain content provided by Cablevision and/or Third-Party Providers, or to protect itself, its Subscribers or any Third-Party Providers. 
(b) Third-Party Providers may monitor Subscriber activity.  When using an Optimum Online Service  provided by a  Third-Party Provider, Subscriber is responsible for reviewing any Terms of Service or similar agreement as posted on the  Third-Party Provider website which, to the extent not inconsistent with the provisions of this Agreement, shall bind the Subscriber.  In the event of a conflict between this Agreement and any  Third-Party Provider Terms of Service, Acceptable Use Policy or any other agreements or restrictions, the provisions of this Agreement shall govern.

(c) Cablevision shall have the right to determine, in its sole discretion, what constitutes "commercial use" of Optimum Online hereunder.

12. Access to Subscriber Premises: Subscriber authorizes Cablevision and its employees, agents, contractors and representatives to enter the Subscriber's premises in order to install, maintain, inspect, repair, and remove the Optimum Online Service, as applicable. All such service shall be conducted at a time mutually agreed to by Cablevision and Subscriber.

13. Assignment or Transfer: The Agreement and the Equipment supplied by Cablevision are not assignable or otherwise transferable by Subscriber.

14. Termination and Expiration:

(a) Termination by Subscriber: Unless otherwise terminated, this Agreement shall automatically renew on a month-to-month basis. Subscriber acknowledges that upon such renewal all pricing is subject to change.  To terminate any recurring service, Subscribers must call Optimum Online at the number listed in Section 8, above, or provide a hardcopy written notice of termination to Optimum Online delivered to the address listed in Section 8, above.  Termination of a service offered for a separate charge billed directly by a  Third-Party Provider shall be effected in accordance with the Terms of Service or similar agreement between the Subscriber and the  Third-Party Provider.

(b) Termination for Bankruptcy: Cablevision shall have the right to terminate this Agreement immediately in the event that Subscriber makes an assignment for the benefit of creditors, or a voluntary or involuntary petition is filed by or against Subscriber under any law having for its purpose the adjudication of Subscriber as a bankrupt or the reorganization of Subscriber.

(c) Termination for Breach: In the event of any breach of this Agreement by Subscriber, the failure of Subscriber to abide by the rates, rules and regulations of Cablevision, the failure of Subscriber to provide and maintain accurate registration information, or any illegal activity by the Subscriber using the Service, this Agreement may be, at Cablevision's option, terminated and Cablevision's Equipment removed. Failure of Cablevision to remove such Equipment shall not be deemed abandonment thereof. Subscriber shall pay reasonable collection and/or attorney's fees to Cablevision in the event that Cablevision shall find it necessary to enforce collection or to preserve and protect its rights under this Agreement.  Cablevision may terminate this Agreement or Cablevision or any  Third-Party Provider may reject an application or block access to or use of any component of the Optimum Online Service for any reason including, but not limited to, if (1) Subscriber violated this Agr!
eement as to this or another account of Cablevision or any third-party provider of services or products, (2) the information required in the registration process is or becomes incorrect, absent or incomplete, (3) Subscriber's credit card issuer refuses a charge or any other payment method fails to compensate Cablevision or a  Third-Party Provider, (4) a violation, as determined in the sole discretion of either Cablevision or a  Third-Party Provider, of the Terms of Service, Acceptable use Policy or similar provisions or agreements with respect to any service, or (4) the amount of technical support required to be provided to Subscriber is excessive in the sole judgment of Cablevision or an affected  Third-Party Provider    Subscriber further agrees that in the event of termination pursuant to subsections (b) or (c), Cablevision and all  Third-Party Providers shall have no liability to Subscriber.

(d) Obligations Upon Termination: The Subscriber agrees that upon termination of this Agreement:

(i) Subject to 14(a), Subscriber will pay Cablevision in full for Subscriber's use of the Equipment and Services up to the later of the effective date of termination of this Agreement and the date on which the Optimum Online Service has been disconnected. The Subscriber agrees to pay Cablevision on a pro-rated basis for any use by the Subscriber of the Optimum Online Service for a part of a month;

(ii) Subscriber will promptly return all Equipment to Cablevision. In the event that Subscriber fails to return any Equipment within ten (10) days of the termination of this Agreement, Subscriber shall be liable to Cablevision for the actual cost of such Equipment, or be subject to a non-return fee, which fee shall be subject to change in accordance with applicable law, or.

(e) The termination of this Agreement for reasons other than Subscriber's bankruptcy shall not affect Subscriber's Cablevision television service.

(f) Should there be a termination or downgrade of Optimum Online Boost, Subscribers will be provided with instructions pertaining to the transition from Optimum Online Boost.

15. Renewal after Cancellation or Termination: Subscriber acknowledges and agrees that in the event of renewal after cancellation or termination of Optimum Online Service, Subscriber shall be subject to the pricing, warranties, and terms of Optimum Online Service as are effective at the time of such renewal.

16. Change In Optimum Online Service: The Optimum Online Service provided hereunder is subject to change in accordance with applicable law.

17. Disclaimer: Cablevision assumes no liability for and exercises no control over the content contained in the Internet, the Services or the content of the Optimum Online Service  to the extent such content is provided by any  Third-Party Provider, including content that is pornographic, obscene, defamatory or otherwise inappropriate or offensive. Further, Cablevision shall not be responsible for any products, merchandise or prizes promoted or purchased through the use of the Optimum Online Service, or the Services unless such products, merchandise or prizes are provided directly by Cablevision.  Subscriber agrees that Cablevision is not liable for any action or inaction with respect to any such content accessible through the Internet, the Services or the content provided by any  Third-Party Provider.

18. Optimum Online Network: The Optimum Online Service utilizes a network that will allow bi-directional direct access to the Internet, i.e. Subscribers can directly access and respond to direct requests from Internet users outside the Optimum Online Service network. The Network is not intended to protect Subscribers from hackers, computer viruses or malicious codes gaining access to their Computer and as such, Subscribers should not rely on it to provide such functions. Cablevision and  Third-Party Providers shall have no liability whatsoever for any claims, losses, actions, damages, suits or proceedings resulting from, arising out of or otherwise relating to damage to the Subscriber or the Subscriber's Computer resulting from the actions of any other third party including, without limitation, downloaded software, hackers or computer viruses regardless of delivery method for example, but not limited to delivery by email, instant messenger, chat, newsgroups, disc, CD, or DVD.

19. Limitation of Liability:

(a) Subscriber expressly agrees that the use of Optimum Online Services, software and Equipment, including that provided by  Third-Party Providers, as well as the purchase, download, or use of any third-party service or product provided by or accessed through Optimum Online Service, is at Subscriber's sole risk and Subscriber acknowledges that this service and these materials are provided "as is" and "as available" for Subscriber's use, without warranties of any kind, whether express or implied. Neither Cablevision nor any third-party provider of services or products, including but not limited to any  Third-Party Provider, makes any representations or warranties with respect to any product or service offered through the Optimum Online Service or the Services, and Cablevision shall not be party to nor responsible for monitoring any transaction between Subscriber and third-party providers of products or services.

(b) Unless otherwise specifically provided in this Agreement, Cablevision and any  Third-Party Provider will not be liable to the Subscriber or to any third party for:

(i) any direct, indirect, incidental, special, punitive or consequential losses or damages, including loss of profits, loss of earnings, loss of business opportunities and personal injuries (including death), resulting directly or indirectly out of, or otherwise arising in connection with the use of Optimum Online Service or provided third party services by the Subscriber or any other use of the Services including without limitation, any damage resulting from or arising out of the Subscriber's reliance on or use of the Optimum Online Service or the Services, or the mistakes, omissions, interruptions, deletion of files, errors, defects, delays in operation, transmission, or any failure of performance of the Optimum Online Service or the Services; and

(ii) any losses, claims, damages, expenses, liabilities or costs (including legal fees) resulting directly or indirectly out of, or otherwise arising in connection with, any allegation, claim, suit or other proceeding based upon a contention that the use of the Optimum Online Service or the Services by the Subscriber or a third party infringes the copyright, patent, trade-mark, trade secret, confidentiality, privacy, or other industrial or intellectual property rights or contractual rights of any third party. This limitation applies to the acts, omissions, negligence and gross negligence of Cablevision, its officers, employees, agents, contractors or representatives which, but for this provision, would give rise to a cause of action against Cablevision in contract, tort or any other legal doctrine.

(c) Cablevision also does not guarantee continuous, uninterrupted or secure access to the Internet. Cablevision does not warrant that service will be available on a specified date or time or that the network will have the capacity to meet your demand during specific hours.  Access to the network cannot be guaranteed, and you may be unable to access the network at any time, and disconnections from the network may occur from time to time.  If you remain connected to the Internet thought the Optimum Online Wi-Fi Desktop Client without activity for five (5) minutes or longer, you may be disconnected.  Access to the Internet using the Optimum Online Wi-Fi Service shall be further subject to the Terms of Service of the Boost Third-Party Provider of that service.  In no event shall Cablevision have any liability arising from the reliability, ability or inability to connect to the Internet, or any other claim, loss, expense, fee or damage arising directly or indirectly from Subscrib!
er's use of the Optimum Online Wi-Fi Service or any component thereof.

20. Multiple Users: Subscriber acknowledges that by "clicking" the Acceptance icon below and/or by using the Optimum Online Service, Subscriber is agreeing to the terms and conditions of this Agreement on behalf of all persons who use the Optimum Online Service or the Services through Subscriber's Computer. Subscriber shall be responsible for ensuring that all Subscribers understand and comply with the terms and conditions of this Agreement. Subscriber acknowledges and agrees that the Subscriber is responsible and liable for any and all breaches of the terms and conditions of this Agreement, whether such breach is the result of use of the Optimum Online Service or Services.

21. Prohibited Uses of Optimum Online Service: Subscriber shall comply with all of Cablevision's standards for acceptable use with respect to the Optimum Online Service and the Services and shall refrain from any and all illegal and/or inappropriate activities, including without limitation as outlined in the Acceptable Use Policy. The Cablevision Internet Product Acceptable Use Policy will be updated from time to time and the latest version will supersede all prior versions. In addition to the prohibitions outlined in the Acceptable Use Policy, the following restrictions apply:

(a) Optimum Online:

(i) Users may not run any type of server on the system. This includes but is not limited to FTP, IRC, SMTP, POP, HTTP, SOCKS, SQUID, DNS or any multi-user forums;

(ii) Users may not register or point a domain, sub-domain, or hostname to any Optimum Online IP address. Moreover, Users may not have traffic redirected to The Service;

(iii) Users may not resell, share, or otherwise distribute the Service or any portion thereof to any third party without the written consent of Cablevision. For example, Subscriber may not provide Internet access to others through a dial up connection, wireless access or host shell accounts over the Internet, provide e-mail or news service, or send a news feed.

(iv) Users may not copy, distribute or sublicense any software provided by Cablevision, except that Subscriber may make one copy of each software program for back up or archival purposes only;

(b) Optimum Online Boost

(i) Users may not run any servers except for a webserver (HTTP) and mail (SMTP) on the system.  This includes but is not limited to FTP, IRC, POP, SOCKS, SQUID, DNS or any multi-user forums.

(ii) Users who opt to run a webserver must do so on port 80 only.  Webservers running on any other port will be deemed a violation of these terms.

(iii) Similarly, users who opt to run a mailserver (SMTP) must do so on port 25 only.  Mailservers running on any other port will be deemed a violation of these terms.

(iv) Users opting to run web or mail servers are expected to secure those services and maintain the security of those services on an ongoing basis.  Mailservers are to be configured against open relay and third party exploitation.

(v) Users may not resell, share, or otherwise distribute the Service or any portion thereof to any third party without the written consent of Cablevision. For example, Subscriber may not provide Internet access to others through a dial up connection, wireless access or host shell accounts over the Internet, provide e-mail or news service, or send a news feed.

22. End User Licenses: Subscriber agrees to comply with the terms and conditions of all end user license  agreements relative the Optimum Online Services, the Services and any service provided by a  Third-Party Provider which Subscriber accesses pursuant to the terms of this Agreement.  All such agreements are incorporated in this Agreement by reference.  Title and intellectual property rights to the services are owned by Cablevision or any third-party provider of service or products, or otherwise by the owners of such material and are protected by copyright laws and treaties.  The reverse engineering of software, copying, distribution, reselling or publication of any part of the Optimum Online Service, the Services or any service provide by a  Third-Party Provider without the written consent of Cablevision, an applicable third-party provider of service or products, and/or other owner of such material is prohibited. 

23. Back-up Requirements: The Subscriber agrees to back-up all existing computer files by compiling them to another storage medium prior to installation of the Equipment. Cablevision shall have no liability whatsoever for any damage to or loss or destruction of any of Subscriber's software, files, data, or peripherals.

24. Viruses: Cablevision may run a third party virus check software on the Subscriber's Computer prior to installing software on the Subscriber's Computer. Subscriber agrees that Cablevision provides such technology "as is" or "as available" and acknowledges and agrees that Cablevision does not represent, warrant or covenant that the virus check software will detect or correct any or all viruses.

25. Cablevision shall not be Liable for:

(i) Eavesdropping; Any information sent by the Subscriber over the Optimum Online network is sent at the Subscriber's sole risk, and Cablevision shall have no liability whatsoever for any claims, losses, actions, damages, suits or proceedings arising out of or otherwise relating to such actions by the Subscriber.

(ii) Multiple Computer Connections; When Subscriber's Computer is connected to a cable Modem, it constitutes a "local" segment. All Subscriber's Ethernet traffic on this local segment will be reflected by the cable Modem in an unencrypted form onto the cable network and be subject to eavesdropping, as previously described in subsection (a)i above.

(iii) File and Print Sharing, Subscriber understands that users outside the Subscriber's authorized service location may be able to access Subscriber's Computer. Further, some software includes capabilities that permit other users across a network such as Optimum Online and the Internet to gain access to the Subscriber's Computer and to the software, files and data stored on the Computer.

(b) Any Subscriber who, (i) chooses to participate in the Optimum Online Service using other than a single, stand-alone Computer connected to the local segment, if and when this capability is offered or (ii) chooses to enable capabilities such as file sharing, print sharing or other capabilities that allows users to gain access to Subscriber's Computer, hereby acknowledges and agrees that the Subscriber does so at the Subscriber's own risk

26. Security. (See Acceptable Use Policy)

(a) Cablevision reserves the right to protect the integrity of its network and resources by any means it deems appropriate. This includes but is not limited to: port blocking, e-mail virus scanning, denying e-mail from certain domains, and putting limits on bandwidth and e-mail.

(b) Subscriber is solely responsible for any misuse of the Optimum Online Service or the Services, as well as for the security of any device you choose to connect to the Optimum Online Service, including any data stored on that device, all as detailed more fully in the Acceptable Use Policy.

27. Inappropriate Content.

There may be content on the Internet or otherwise available through the Optimum Online Service or the Services which may be offensive to some individuals, or which may not be in compliance with all local laws, regulations and other rules. For example, it is possible to obtain access to content that is pornographic or offensive, particularly for children. Neither Cablevision nor any Third-Party Providers can assume any responsibility for the content contained on the Internet or otherwise available through the Services. Subscriber  must assume the risk of accessing content through the Service, and neither Cablevision nor any  Third-Party Providers shall have any liability for any claims, losses, actions, damages, suits or proceedings arising out of or otherwise relating to access to such content. Subscriber is solely responsible for any information that Subscriber publishes on the web or other Internet services. Subscriber must ensure that the recipient of the content is appropriate. For example, Subscriber must take appropriate precautions to prevent minors from receiving inappropriate content. Cablevision and any Third-Party Providers reserve the right to refuse to post or to remove any information or materials, in whole or in part, that it, in its sole discretion, deems to be offensive, indecent, or otherwise inappropriate regardless of whether such material or its dissemination is unlawful.

By using the Optimum Online Service or the Services to publish, transmit or distribute content, a Subscriber is warranting that the content complies with this Policy and authorizes Cablevision and all  Third-Party Providers to reproduce, publish, distribute, and display such content worldwide.

28. Electronic Mail.

Users must adhere to the Optimum Online e-mail policies set forth in the Acceptable Use Policy.  The following additional restrictions apply to Optimum Online Boost Subscribers:

(a) Users are not permitted to send bulk, marketing, advertisement, or similar email through the Optimum Online mail system.  Subscribers are required to send email of that nature through a mail server on their local system or through a third party service.

Optimum Online Boost Subscribers operating mail servers and sending bulk emails must comply with the following guidelines:

i) Users must develop their own double opt-in marketing lists.  Use of email lists from third parties is not permitted.  (Potential e-mail subscribers should always ask for communication and never have it forced upon them.)

(ii) Permission of any new e-mail subscribers to User's mailing list must be fully verified before mailings commence.  (This is usually accomplished through an email message sent to the e-mail subscriber to which s/he must reply, or containing a URL that s/he must visit, in order to complete the subscription.) Should the subscriber decline to respond, no further messages may be sent.

(iii) Users must keep logs of the user subscription process.  The IP address, date and time, and email address of users' e-mail subscription activity may be necessary to settle any disputes.

(iv) Mailing list administrators must provide a simple method for e-mail subscribers to terminate their e-mail subscriptions, and administrators must provide clear and effective instructions for unsubscribing from a mailing list. Mailings must cease within twenty-four (24) hours of an e-mail subscription being terminated.

(v) Users should ensure alternative methods for terminating an e-mail subscription. Mailing list administrators should make an "out of band" procedure (e.g., an email address to which messages may be sent for further contact via email or telephone) available for those who wish to terminate their mailing list subscriptions but are unable or unwilling to follow standard automated procedures.

(vi) Undeliverable addresses must be removed from User's mailing list upon notification. Mailing list administrators must ensure that the impact of their mailings on the networks and hosts of others is minimized.  One of the ways this is accomplished is through pruning invalid or undeliverable addresses.

(vii) List administrators must take steps to ensure that mailings do not overwhelm less robust hosts or networks.  For example, if the mailing list has a great number of addresses within a particular domain, the list administrator should contact the administrator for that domain to discuss mail volume issues.

(viii) Terms and conditions of address use must be fully disclosed by User.  Mailing list administrators must make adequate disclosures about how e-mail subscriber addresses will be used, including whether or not addresses are subject to sale or trade with other parties.  Also, conditions of use should be visible and obvious to the potential subscriber. For example, two lines buried deep within a license agreement do not constitute adequate disclosure.

(ix) Users must be aware that some networks refuse to accept mail from dynamically assigned IP address blocks.  Cablevision makes no warranty or guarantee that third party networks will accept the User's mail nor is Cablevision responsible for ensuring continued acceptance of email by third party networks.

(x) Users must abide by all Federal, state, and local laws that pertain to email communications in addition to the restrictions set forth in this document and the Acceptable Use Policy.

(xi) It is the User's responsibility to incorporate any sender authentication protocols into its mailing processes.

Cablevision may, at its discretion, provide, offer for sale or subscription, or otherwise make available to Subscribers software or services for e-mail filtering, anti-virus scanning, and other e-mail security solutions for the convenience of Subscribers. Cablevision shall not be responsible for nor have any liability with regard to the e-mail that Users receive, nor for any lost or filtered e-mail, nor for any failure to prevent virus delivery or infection.

Subscriber agrees that Subscriber has been informed that Optimum Online service includes a filter that diverts commercial mass mailings ("spam") from User's inbox. Subscriber has been informed in addition that Subscriber may opt out of this filtering service at any time by following the instructions in the User Guide.

Cablevision is not responsible for the forwarding of e-mail sent to any account that has been suspended or terminated. Such e-mail will be returned to sender, ignored, deleted, or stored temporarily at Cablevision's sole discretion. Cablevision reserves the right to reclaim any and all e-mail addresses from Subscribers whose service has been cancelled or terminated, regardless of the reason for such cancellation or termination.

31. Violation of Acceptable Use Policy / Terms of Service

Cablevision does not routinely monitor the activity of accounts for violation of this Policy. However, in our efforts to promote good citizenship within the Internet community, we will respond appropriately if we become aware of inappropriate use of our Optimum Online Service.

Neither Cablevision nor any of its distribution affiliates has any obligation to monitor transmissions made on the Optimum Online Service or the Services. However, Cablevision and its distribution affiliates have the right to monitor such transmissions from time to time and to disclose the same in accordance with these terms and conditions.

You hereby authorize Cablevision and its distribution affiliates to cooperate with (i) law enforcement authorities in the investigation of suspected criminal violations, and (ii) and system administrators at other Internet service providers or other network or computing facilities in order to enforce this Policy. Such cooperation may include Cablevision providing the username, IP address, or other identifying information about a subscriber.

Upon termination of an account, Cablevision is authorized to delete any files, programs, data, and e-mail messages associated with such account.

The failure of Cablevision or its distribution affiliates to enforce this Policy, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

You agree that, if any portion of this Policy is held invalid or unenforceable, that portion will be construed consistent with applicable law as nearly as possible, and the remaining portions will remain in full force and effect. This Policy shall be exclusively governed by, and construed in accordance with, the laws of the State of New York.

32. Bandwidth, Data Storage and Other Limitations

Subscriber agrees to comply with Cablevision's bandwidth, data storage and other limitations of the Optimum Online Service as established and modified by Cablevision from time to time. Subscriber agrees that its activity will not improperly restrict, inhibit or degrade any other Subscriber's use of Optimum Online Service, nor represent (in the sole judgment of Cablevision) an unusually large burden on the network itself. In addition, Subscriber agrees that its activity will not improperly restrict, inhibit, disrupt, degrade or impede Cablevision's ability to deliver and monitor Optimum Online Service, backbone, network nodes, and/or other network services.  Cablevision and any Third-Party Provider reserve the right to implement processes to manage, shape, or optimize traffic on its network.

Optimum Online provides up to 5 e-mail accounts that are limited to 20 megabytes of storage space each and to 90 days of storage. Optimum Online reserves the right to modify, delete, or otherwise correct any accounts that exceed either limitation.

Optimum Online Boost provides up to 15 email accounts that are limited to 1 gigabyte of storage space each and unlimited storage time.  Optimum Online reserves the right to modify, delete, or otherwise correct any accounts that exceed limitations.

To preserve e-mail you do not want deleted, you can set your e-mail account to ensure that your e-mail is automatically stored on your computer's hard drive when you open it. Please check the Help section or the FAQ on your e-mail client (e.g.., Outlook Express, Eudora) to find out how this can be done.

33. Third-Party Premium Services

Optimum Online Service may offer additional third-party services to subscribers at no extra cost or for an additional fee.  Subscribers agree to the following restrictions pertaining to third party services:

(a) In addition to the Service Terms of Service and Acceptable Use Policy, Subscriber must adhere to the third party's terms and policies to the extent such terms and policies are not inconsistent with the provisions of this Agreement or Cablevision's Acceptable Use Policy.

(b) See section 19 for the statement of Cablevision's and certain third-parties' liability.

(c) Use of included third party services is limited to Subscribers in good standing.  Accounts that are not in good standing are subject to restricted or suspended access to these third party services.

(d) Abusive use, in Cablevision's sole opinion of third party services may result in corrective action as outlined in the Acceptable Use Policy.

34. Installation

(a) Cablevision does not represent, warrant, or covenant that installation modifications, including installing network cards or similar computer equipment, and modification of computer files such as INI, BAT, SYS, .DLL and other system configuration files will not disrupt the normal operations of the Subscriber's Computer. Cablevision shall have no liability whatsoever for any damage resulting from the above or other file modifications.

(b) Upon Subscriber's request, Cablevision or its agents will install certain software, an extra cable outlet (if necessary), a cable Modem and associated equipment. Cablevision will also provide a user's manual and instructions on how to use Optimum Online Service. If installed by Cablevision, Cablevision shall use reasonable efforts to install the Optimum Online Service to a fully operational status.

(c) All installation services performed by Cablevision shall be subject to Cablevision's applicable service charges, if any.

35. Amendment: Cablevision may, in its sole discretion, change, modify, add or remove portions of this Agreement at any time. Cablevision may notify Subscriber of any such changes to this agreement by posting notice of such changes on the Optimum Online Service, or sending notice via e-mail or postal mail. The Subscriber's continued use of the Optimum Online Service following notice of such change, modification or amendment shall be deemed to be the Subscriber's acceptance of any such modification. If Subscriber does not agree to any modification of this Agreement, Subscriber must immediately cease using the Optimum Online Service and notify Cablevision that Subscriber is terminating this Agreement in accordance with Section 14 of this Agreement. Additionally, this Agreement may be superseded by an Optimum Online user subscription agreement subject to your approval, which shall be indicated by your use of the Optimum Online service described herein.

36.  Additional Terms for Optimum Online Video

(a)  Services Provided: Cablevision's Optimum Online Video Services provide video programming that may include live TV programs delivered on a live stream or downloads of other video content.  Optimum Online Video Services are available to Optimum Online Boost Subscribers via optonline.net.  Digital rights management controls playback functions and distribution of all the video contents that are downloaded.

(b) Monthly Service Fee: Available to all Optimum Online Boost Subscribers at no additional charge.  Additional charges, if any, and methods of payment are listed at the point of purchase.  Any additional charges, including fees, taxes and surcharges, if any, may be added to Subscriber's monthly Cablevision bill.

(c) Equipment/Software Required: Optimum Online Video Services require Optimum Online Media Player for watching live TV programs and Windows Media Player for watching video downloads.

37. Additional Terms for Optimum Online Wi-Fi Service

(a) Services Provided: Cablevision's Optimum Online Wi-Fi Service provides dial-up and wireless web portal and desktop client. 

(b) Service Fee: All the service fees, applicable taxes and other fees, e.g., roaming fees if applicable, are charged on Subscriber's credit card based by the Third-Party Provider upon the rate plan of Subscriber's choice.  All service fees are billed monthly and in advance.

(c) Features: The following technical support services are available from the Third-Party Provider:
A. Assistance with wireless card configuration support on a limited basis.
B. Information regarding account cancellations is provided.
C. Assistance with username and password inquiries.
D. Assistance with billing and refund inquiries.

(d) Term: Optimum Online Wi-Fi Service shall continue until such time as terminated by Subscriber, which shall be effective at the end of the current Optimum Online Wi-Fi Service billing cycle (no refunds for mid-cycle terminations), or terminated by Cablevision for breach (including, but not limited to, nonpayment) or violation of the Terms Of Use of Optimum Online Wi-Fi Service or Agreement for Optimum Online and Optimum Online Boost, providing inaccurate registration information, using Optimum Online Wireless Portal to perform any illegal activity and any violation of the Cablevision Optimum Online Terms of Service.   Subscriber agrees that in the event of termination for any reason, Cablevision shall have no liability to Subscriber.

38. Additional Terms of Service for Optimum Online Web Hosting

(a)  Services Provided:  Cablevision's Optimum Online Web Hosting Service provides Optimum Online Boost Subscribers with Website creation tools that enables web hosting on their own computers or without having to use their computers as the web server.  Optimum Online Web Hosting Service is available for residential and commercial Subscribers.   

(b) Web Hosting Features: The following features may include:

A. Disk space for storing files used to create a website.
B. Domain name registration includes domain name forwarding, a secure Web-based control panel, nameserver management, renewal protection service and etc.
C. Website building tools.
D. Shopping cart functions.
E. Search engine submission and optimization.

(d) Term: Optimum Online Web Hosting service shall continue until such time as it is no longer offered by Cablevision as part of Optimum Online Boost, terminated: (i) by Cablevision for breach or violation of this Agreement or Cablevision's Acceptable Use Policy; or (ii) terminated by Cablevision or the applicable Boost Third-Party Provider for providing inaccurate information to register or reserve Subscriber's domain name or register for other services of the same Boost Third-Party Provider or providing false or misleading information, or concealing or omitting any information deemed material to register or reserve Subscriber's domain name.  Subscriber agrees that in the event of termination for any reason, neither Cablevision nor the applicable Boost Third-Party Provider shall have no liability to Subscriber.

(e) Subscriber Restrictions: Any Optimum Online Web Hosting activity deemed to be adversely affecting server performance or network integrity, at the sole discretion of Cablevision or the Third-Party Provider may be terminated by Cablevision or the Third-Party Provider without prior notice.

(f) Domain Name Disputes:  Subscriber agrees that, if any domain name used by a Subscriber and hosted through the Optimum Online Service is challenged by a third party, Subscriber will resolve such challenges in accordance with the terms of the Uniform Domain Name Dispute Resolution Policy as most recently approved by the Internet Corporation for Assigned Names and Numbers.  Subscriber shall fully indemnify and hold harmless Cablevision and the Third-Party Provider from all losses, costs, expenses (including reasonable attorney costs) and fees incurred as a result of Subscriber's use of any domain name.

(h) Right of Refusal: The Third-Party Provider reserves the right to refuse, in its sole discretion, to register or reserve Subscriber's chosen domain name or register Subscriber for other service(s) of the Third-Party Provider, or to delete Subscriber's domain name within thirty (30) calendar days from receipt of such registration.  Subscriber agrees that in the event of refusal for any reason, Cablevision and Third-Party Provider shall have no liability to Subscriber.

(i) Amendment:  Subscriber acknowledges that if s/he does not agree to any amendments made by Cablevision to this Agreement, Subscriber may request that his/her domain name be deleted from the domain name database.

Cablevision
Internet Product Acceptable Use Policy

This Acceptable Use Policy ("AUP") has been created to promote the integrity, security, reliability, and privacy of Cablevision's Internet Product Network ("the Service").  The AUP works in conjunction with the Terms of Service ("TOS") of each particular product and specifies actions that are prohibited by users of the Service.  Cablevision reserves the right to modify the AUP at any time and any such modifications shall be automatically effective to all users when adopted by Cablevision.  The customer recognizes and agrees that the on-line AUP to be maintained by Cablevision will supercede all previous versions of this document.

Use of the Service is subject to the following rules and guidelines as well as product specific Terms of Service included with the contract.  Each customer of the Service is responsible for ensuring that the use of all services provided complies with this AUP and associated TOS.  Any user who does not agree to be bound by these terms should immediately stop their use of the Service and notify their Customer Service Department to terminate the account.

Illegal Use
The Service may be used only for lawful purposes.  Transmission or distribution of any material in violation of any applicable law or regulation is prohibited.  This includes, without limitation, material protected by copyright, trademark, trade secret, or other intellectual property right used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.  Furthermore, use of the Service to impersonate a person or entity is not permitted. 
System and Network Security
Violations of system or network security are prohibited and may result in criminal and civil liability.  Examples of system or network security violations include, without limitation, the following:

* Unauthorized access to or use of data, systems, or networks, including any attempt to probe, scan, or test the vulnerability of a system or network, relay communication through a resource, or to breach security or authentication measures without express authorization of the owner of the system or network

* Unauthorized monitoring of data or traffic on any network or system without express authorization of the owner or network.

* Interference with service to any user, host, or network, including but not limited to: mail bombing, flooding, or denial of service attacks

* Forging the header of any transmitted information packet, email, or Usenet posting.

* Modifying or tampering with any hardware, software, or configuration provided by Cablevision including but not limited to: routers, switches, and cable modem configuration files

* Disrupting any aspect of the Cablevision Internet Network through any means

* Excessive use of bandwidth, that in Cablevision's sole opinion, goes above normal usage or goes beyond the limit allocated to the user.  Commercial service level agreement customers are entitled to the bandwidth specified in the SLA and are exempt from this provision.

* Assuming or assigning a Cablevision IP address that was not allocated to the user by Cablevision or its network - all residential users must use DHCP to acquire an IP address, business users should refer to the specific product TOS for further clarification


Electronic Mail
Spam - Cablevision defines "SPAM" as any email or electronic communication including, but not limited to, instant messenger programs, IRC, Usenet, , etc. that promotes or advertises a service, product, cause, opinion, money making opportunity, or the like that the recipient did not specifically request from the sender.  The communication does not necessarily have to pass through the Service's email infrastructure - it only needs to originate from a service user.  Optimum Online users may not send any communication meeting the definition above regardless of whether the recipient requested it or not.  Business users should refer to their TOS for further clarification of this issue. 

Cablevision maintains a zero-tolerance policy on Spam for all of its Internet products and will take immediate action against users violating this policy.

Cablevision's Internet services may not be used to collect responses from unsolicited communication regardless of the communication's origination.  Moreover, unsolicited communication may not direct the recipient to any web site or other resource that uses the Service and the user may not reference the Service in the header or by listing an IP address that belongs to the Service in any unsolicited communication even if that communication is not sent through the Service or its infrastructure.

Users may not send any type of communication to any individual who has indicated that he/she does not wish to receive messages from them.  Continuing to send email messages to anyone that has expressly requested not to receive email from you is considered to be harassment.

USENET/Internet Chat
Users may not SPAM newsgroups or chat rooms and must comply with the written charters, FAQs, rules, or terms of service for those forums the user chooses to participate.  The user is responsible for determining the policies of a given group/room before posting to it.  Additionally, users are not permitted to:

* Cross-post the same or substantially similar message excessively - in Cablevision's sole opinion

* Post binary files to non-binary groups

* Flood or disrupt a group

Abusable Resources
Customers shall take all necessary steps to avoid actions that result in the abuse of a resource on their network.  Examples of abusable resources include but are not limited to: open news servers, open SMTP servers, insecure routers, wireless access and insecure proxy servers.  Upon notification from Cablevision, users are required to address the problem in a timely fashion.  Failure to address an issue after notification will be considered a violation of this AUP.  Not all products permit use of these types of services, please refer to your product specific TOS for further clarification.

User Responsibility
The user is solely responsible for the security and misuse of any device that is connected to the Service.  Cablevision recommends that users implement appropriate measures to secure their systems and these measures may include installation of firewalls, antivirus protection with regular updates, regularly checking for and applying security patches for software and operating systems, and general security conscience use of the service.

Viruses
Service users must take appropriate action to prevent their systems from becoming infected with and/or distributing computer viruses.  Cablevision will take appropriate (as decided by Cablevision) action against users infected with computer viruses or worms to prevent further spread.

Enforcement
Cablevision reserves the right to investigate violations of this Policy, including the gathering of information from the user or users involved and the complaining party, if any, and the examination of material on Cablevision's servers and network. Cablevision prefers to advise customers of AUP violations and any necessary corrective action but, if Cablevision, in its sole discretion, determines that a user has violated the AUP, Cablevision will take any responsive action that is deemed appropriate without prior notification. Such action includes but is not limited to: temporary suspension of service, reduction of service resources, and termination of service. Cablevision is not liable for any such responsive action and these actions are not exclusive. Cablevision may take any other legal or technical action it deems appropriate.

The failure of Cablevision to enforce this policy, for whatever reason, shall not be construed as a waiver of any right to do so at any time.


Optimum Voice Terms of Service

Additional terms of service for commercial or business Subscribers can be found at http://www.optimum.com/support/terms.jsp?t=ool apply. In the event of a conflict between the commercial/business terms of service and these Terms of Service for such authorized Subscribers, the former shall govern.

1. Services Provided: Cablevision's Optimum Voice digital phone service provides unlimited calling within the United States, Puerto Rico (except for commercial or business Subscribers) and Canada in connection with Cablevision's Optimum Online service in accordance with the following terms and conditions. Optimum Voice also offers an optional international calling plan for direct-dialed calls made from the customer's home to locations outside of the U.S., Puerto Rico and Canada.

2. Monthly Service Fee: Subscriber agrees to pay the monthly service charge for Optimum Voice service. Optimum Voice service is offered only as an additional service of Cablevision's Optimum Online offering and may not be purchased as a stand-alone service. Optimum Voice is offered only to the Cablevision authorized address where Optimum Online service is provided. Cablevision reserves the right to increase or decrease the fee for any services offered. Fees for Optimum Voice service shall be posted at the Optimum Voice Web site. Optimum Voice service will be terminated in the event the subscriber does not pay.

3. Optimum Voice Service Features: Optimum Voice service is offered with the following features:
(a) Unlimited local, regional and long distance calling within the United States, Puerto Rico and Canada, including 800 service, call waiting, caller ID with name, call waiting with caller ID, anonymous call blocker, anonymous calling, find me, VIP ringing, busy redial, caller ID blocking (*67), call return (*69), three-way calling, call forwarding, enhanced voicemail, My Optimum Voice Web portal, unlimited inbound calling and unlisted telephone number. Direct-dial calls outside of the U.S., Puerto Rico and Canada are available only with the Optimum Voice International Calling Plan at an additional per minute charge. Optimum Voice does not support directory listed numbers, busy line verification, busy line interruption, and operator assisted calling (including person to person and station to station calling), pay services or third-party billing. Call forwarding is not available outside the continental U.S.
(b) Enhanced 911 (E-911) is a feature of the Optimum Voice service that allows emergency operators to automatically know the telephone number and address of the dialing party.

This E-911 feature has certain requirements in order to operate, as well as certain limitations:
i. The emergency service provider handling the E-911 call, and the address the emergency service provider will see, are linked to the address Cablevision has on file when the subscriber originally signed up for service. If the subscriber does not correctly identify where the subscriber's voice-enabled cable modem is actually located, or if the voice-enabled cable modem is moved away from the original address, the subscriber's 911 calls may be misdirected to the wrong home or to the wrong emergency service provider.

Therefore, in order to have 911 calls routed correctly, the subscriber acknowledges responsibility to promptly notify Cablevision of any change in service address.
ii. Optimum Voice Service does not have its own power supply. If there is a power outage, or if there is a disruption to the cable network or facilities, the Service will not work. Subscriber expressly acknowledges that in such cases it will not be possible to place or receive calls including calls to access emergency 911 services.
iii. subscriber so chooses, subscriber may separately purchase a back-up battery for use with their voice-enabled cable modem in the instance of a non-network related outage at http://www.optimum.com/voice/customize/battery.jsp

(c) One line and telephone number per cable modem is offered with Optimum Voice service.
(d) Optimum Voice offers both professional and self installation:

There are two options for professional installation of the service:
i. Basic installation:  Cablevision will connect one (1) telephone to the Optimum Voice cable modem. Cablevision is not responsible for connecting other phones in the home to the Optimum voice cable modem.
ii. Home wiring solution: Optimum Voice provides a home wiring solution that enables customers to use Optimum Voice on existing home phone jacks. Cablevision reserves the right to determine the manner in which the home wiring solution is executed in the subscriber's home. In certain cases, Cablevision may be required to alter or adapt the subscriber's inside wiring so that Optimum Voice is available on the existing phones. Customers that wish use Optimum Voice as the connection between their home security system and central station monitoring, must request the Enhance Wiring solution:
1. OptimumVoice does not offer a wire maintenance plan. The subscriber is solely responsible for maintaining all inside wire and phones within the home. Optimum Voice will troubleshoot and fix reported problems for a specified service charge. The service charge is based on the then current rate in effect.
2. In certain buildings such as multiple dwelling units, Optimum Voice may not have access to the subscriber's inside wiring located within the apartment unit. In these instances, Cablevision has the right to determine how best to wire the subscriber's home, either by installing a predetermined number of new jacks in the customer's home or by performing a Basic Optimum Voice installation described above.

(e) With self installation, a self-install kit is shipped directly to a subscribers home. With this kit, the customer will be able to connect one (1) telephone to the Optimum Voice cable modem.
(f) Optimum Voice offers an optional international calling plan for direct-dialed calls made from the customer's home to locations outside of the U.S., Puerto Rico and Canada. The international calling plan also includes a remote calling feature that enable the subscriber to make international calls, as well as domestic calls, when they are away from home. A Subscriber who chooses to participate in the international calling plan will be charged for direct-dial international calls and remote calls in addition to the flat monthly recurring rate that the Subscriber pays for Optimum Voice service. Subscribers may enroll in the optional international calling plan through the My Optimum Voice web portal located at http://www.optimum.com/voice/myov.jsp. The Optimum Voice international calling plan is provided under the terms and conditions of this Agreement, the Terms of Service for Optimum Online Service, and the specific terms and conditions governing Subscriber's enrollment in this optional calling plan. You may access the specific terms and conditions applicable to the international calling plan.

Cablevision reserves the right to modify service features at any time.

4. Optimum Voice Service Limitations:
(a) Service outages: Your Optimum Voice modem is electrically powered and will not work in a power outage or if broadband connection is disrupted or not operating. In the event of power outages, the modem, including all phones and services connected to or powered by it, will not work. Power outages will disrupt Enhanced 911 service, and the use of Optimum Voice as the connection between a home security system and/or emergency medical alert system and central monitoring services. Subscribers may choose to purchase a back-up battery for use in the event of a non-network related outage at http://www.optimum.com/voice/customize/battery.jsp.
(b) Home security systems: If you have a centrally monitored home security system, and select our Enhance Wiring option, Optimum Voice will be wired so that it may be available for use with such system. Although Optimum Voice will supply a connection that will allow the operation of your existing home security system, Optimum Voice does not guarantee that any such system will be in complete operational order following the installation of Optimum Voice. As such, it is your obligation to contact your home security system provider to inform them of your Optimum Voice installation and any change in phone number and to request a complete operational test of such system immediately following installation of your Optimum Voice service. In addition, it is your responsibility to test your system on a regular basis. In the even of power outage or network outage (whether unplanned or maintenance related), your Optimum Voice service, including any home security system, which uses Optimum Voice to connect to central station monitoring, will not function. As set forth in Section 3(B) above, if subscriber so chooses, subscriber may separately purchase a back-up battery for use with their voice-enabled cable modem in the instance of a non-network related outage at http://www.optimum.com/voice/customize/battery.jsp.
(c) Like any other communications service provider, we do not represent that our service is fail-safe. In addition, Cablevision does not guarantee that Optimum Voice will function as the connection between medical alert systems and central station monitoring, and will neither connect to such services nor provide technical support for the connection.
(d) Limitations on operator assisted calls: Currently certain operator assisted services such as busy line verification, busy line interruption and operator assisted calling (including person-to-person and station-to-station calling), dial around services (10-10-XXX), pay services (900 and 976 services), collect calling and third-party billing are not offered with the Optimum Voice service.

5. Equipment required: Optimum Voice service requires a voice-enabled cable modem. Cablevision will supply a voice-enabled modem without charge for so long as Subscriber remains an Optimum Voice customer or until Cablevision changes this service offering. Upon termination of either Optimum Voice or Optimum Online Service for any reason, Subscriber may be asked to return the Cablevision supplied (excluding purchased modems) voice-enabled cable modem within thirty (30) days or Subscriber will be charged an equipment fee equal to the fee charged by Cablevision at the time the voice-enabled modem was supplied by Cablevision. Alternatively, Subscriber may purchase a voice-enabled cable modem from Cablevision. The cost for the purchase of the voice-enabled modem will be charged to Subscriber's Cablevision service bill. In the event Subscriber purchases the voice-enabled cable modem from Cablevision and terminates services within thirty (30) days, Subscriber may return the modem for a full credit of the purchase price.

6. Term: Optimum Voice Service shall continue until such time as terminated by subscriber, which shall be effective upon one (1) day's notice, or terminated by Cablevision for breach (including nonpayment) of the Optimum Voice Service Terms and Conditions or the Agreement For Optimum Online Residential Non-Commercial Service, or otherwise terminated by Cablevision in accordance with these Terms and Conditions.

7. Incorporation of Cablevision's Agreement For Optimum Online Residential Non-Commercial Service Terms and Conditions: Optimum Voice services are offered as an additional service of Cablevision's Optimum Online service offering. Subscriber agrees that the Agreement For Optimum Online Residential Non-Commercial Service Terms and Conditions, including, but not limited to, the sections entitled Limitation of Liability and Force Majeure, are incorporated into the Optimum Voice Service Terms and Conditions and shall apply to Optimum Voice services. The Optimum Voice Service Terms and Conditions shall control in the event of any conflict with the terms and conditions of the Agreement For Optimum Online Residential Non-Commercial Service. 8. Installation: Charges for installation services and equipment will be charged at the then current rate in effect.

9. Taxes: Applicable fees and surcharges, if any, will be added to your monthly bill.

10. Prohibited Uses: Optimum Voice service may be used as a residential voice service only and may not be used for commercial purposes, including, but not limited to, telemarketing, call center services, medical transcription or facsimile broadcasting. In addition, auto-dialers and predictive dialers may not be used with Optimum Voice service. Cablevision reserves the right to disconnect without notice any prohibited transmissions or uses, and to terminate service in the event of violation of the foregoing use restrictions.

11. Amendment: Cablevision may, in its sole discretion, change, modify, add or remove portions of the Optimum Voice Service Terms and Conditions at any time. Cablevision may notify subscriber of any such changes by posting notice of such changes on the Optimum Voice Web site, or sending notice via e-mail or postal mail. The subscriber's continued use of the Optimum Voice service following notice of such change, modification or amendment shall be deemed to be the subscriber's acceptance of any such modification. If subscriber does not agree to any modification of the Optimum Voice Service Terms and Conditions, subscriber must immediately cease using the Optimum Voice service and notify Cablevision that subscriber is terminating Optimum Voice service. In addition, Optimum Voice Service Terms and Conditions are subject to change in compliance with applicable law.

12. Entire Agreement: The Optimum Voice Service Terms and Conditions shall be posted at Optimumvoice.com and are the only terms and conditions that govern Optimum Voice service. No undertaking, representation or warranty made by any agent or representative of Cablevision in connection with the sale, installation, maintenance or removal of Optimum Voice services shall modify or amend the Optimum Voice Terms and Conditions posted at Optimumvoice.com.
